What is Sexual Abuse in Arizona & What are the Charges?

Under Arizona law, sexual abuse involves intentionally or knowingly engaging in sexual contact with any person who is fifteen or more years of age without their consent. It may also involve sexual activity with somebody under fifteen, even if they consented. 

Phoenix views charges of this nature very seriously. The court classifies it under the following criteria: 

  • Class 5 Felony: Sexual abuse is a class 5 felony under most cases. The offender may receive 2+ years in prison, supervised probation, and fines up to $15,000. 
  • Class 3 Felony: Sexual abuse is a class 3 felony when the victim is under 15 years of age, as this makes it a Dangerous Crime Against Children (DCAC). For this charge, the offender can face between 2 and 25 years in prison, depending on previous criminal history. The court may include supervised probation and up to $150,000 in fines within these penalties.
