ARS 13-3102  lists a set of criteria that describe misconduct involving a weapon and the penalties associated. 

A crime of this nature can encompass a range of activities, including but not limited to:

  • Using a weapon in the commission of a crime
  • Prohibited possessor violations

Here is a list of common charges associated with misconduct involving a weapon: 

Class 2 Felony (Most Severe) - Offenders can face this charge if they use a weapon to commit an act of terrorism. You can receive between 3 and 12.5 years in prison, as well as probation. If you have a prior conviction, the prison sentence can escalate to upwards of 23 years in prison. 

Class 3 Felony - You can face a Class 3 Felony for a few different reasons. These include: 

  1. Engaged in a walk-by or drive-by shooting at any occupied location.
  1. Fired a gun in an occupied building or structure to further gang activities.
  1. Sold or provided a firearm to someone knowing they intended to commit a felony offense.
  1. A Class 3 Felony can result in 6 months to 3 years in prison.

  1. Defacing a weapon
  1. Selling, transferring, or transporting a weapon to someone legally barred from possession.
  1. Concealing a deadly weapon in a vehicle while committing a crime.

Class 1 Misdemeanor (Least Severe) - You can face a class 1 misdemeanor charge if you have been caught: 

  1. Carrying a concealed weapon into a polling station, school property, an event after being asked not to, or public premises.
  1. Failing to notify law enforcement about the weapon.
