Understanding Harassment Laws in Arizona

Arizona law enforcement broadly defines harassment as any act or conduct that makes a person feel reasonably alarmed, annoyed, threatened, or harassed. This could include repeatedly initiating unwanted communication or following somebody in public places.

While harassment laws can become complex and overwhelming, we’ve listed some of the most important factors below.

  • Criminal Harassment - Arizona Revised Statute (A.R.S.) § 13-2921 criminalizes harassment, specifically focusing on behavior intended to harass, annoy, or alarm another person. Common examples of criminal harassment include:
    • Following someone in a public place without a legitimate reason.
    • Continuous, unwanted communication (e.g., repeated phone calls, texts, emails).
    • Stalking behavior.
    • Verbal or physical threats.

Crimes of this nature are typically charged as a Class 1 Misdemeanor and can result in up to 6 months in jail, $2,500 in fines, and probation after time served.

  • Aggravated Harassment - Arizona Revised Statute (A.R.S) § 13-2921.01 states that aggravated harassment occurs if the victim has a court-issued protective order in place (such as a restraining order), and the defendant knowingly commits harassment in violation of that order. Aggravated harassment can be charged as a Class 6 felony. This charge can result in up to 2 years of prison time, upwards of $2,500 in fines, and a long probation period. Those with a felony on their criminal record also suffer a loss of crucial rights like carrying a firearm, serving in the military, and finding decent housing or employment.
  • Cyber Harassment - Arizona law also addresses cyber harassment. This involves using electronic platforms (social media, texting, emailing, etc.) to harass or intimidate someone. In cases involving minors, it can include threats, defamation, or sharing inappropriate images.

These laws go much deeper and include different challenges when fighting a harassment charge in court. At Charity Clark Law, we have over a decade of experience and the rigorous case law knowledge to build the right strategy for your circumstances. We take a look at the details from every angle to shape the best defense. Our team will do everything in our power to win your case.

Common Defenses Against Harassment in Arizona

At Charity Clark Law, we provide a personalized experience for every harassment client because no two situations are the same. While we do go the extra mile to build a custom strategy, here are some common defenses we can weave together.

  • Lack of Intent - One of the key elements of a harassment charge is the intent to harass, annoy, or alarm the victim. If we can prove that your actions were unintentional or misunderstood, that could be a valid defense.
  • Lack of Sufficient Evidence - The prosecution must provide evidence that your actions amounted to harassment. If that evidence is weak, unclear, or does not prove the elements of harassment beyond a reasonable doubt, we may be able to dismiss the case.
  • Freedom of Speech - We may be able to argue that your communications were protected under the First Amendment right to free speech. For this defense to work, the speech must not rise to the level of threats, defamation, or other types of prohibited speech.

The right strategy could make all the difference, so it’s crucial to work with an experienced attorney. Our legal team offers a free consultation to sit down, understand your circumstances, and build a custom defense against your harassment charge. We lead with compassion, empathy, and understanding for every client – no questions asked.
